Information on the submission of an application for recognition as a beneficiary of temporary protection and use the electronic data recording platform


Upon application, Ukrainian nationals (i.e., recognise them as beneficiaries of temporary protection) who fled from Ukraine on 24 February 2022, or afterwards, persons recognised either as a stateless person or as a refugee by Ukraine, and family members of the abovementioned persons can be granted temporary protection by Hungary.

 

A person applying for recognition as a beneficiary of temporary protection shall provide proof before the Asylum Authority that (s)he meets one of the abovementioned conditions.

 

1. Electronic data recording

In order to speed up the application process, applicants for recognition as a beneficiary of temporary protection shall be allowed to provide their data to the Asylum Authority in advance via the following interface.

 

Please note that recording your data electronically shall not be considered as application submission; applicants are still required to appear in person before the Asylum Authority after they have recorded their data electronically. Considering the authority’s obligation to verify the identity of the applicant for recognition as a beneficiary of temporary protection, to take a facial photograph of him/her and his/her fingerprints, the applicant’s appearance in person before the authority may not be waived.


A newborn child of a person with beneficiary of temporary protection status shall not be granted beneficiary of temporary protection status. In order for a newborn child to be granted beneficiary of temporary protection status, an application for recognition as a beneficiary of temporary protection with regards to the child is to be submitted, for which the parent(s) are required to appear in person before the authority as soon as possible after the birth of the child for the purpose of registering the required data. Presenting the child’s birth certificate is necessary when submitting the application, regardless of the fact that the child’s other personal documents are not yet available (i.e., they are still in the process of being produced or delivered).

 

The costs of the medical care of the newborn child will be reimbursed by the Asylum Authority only after the submission of the newborn child’s application for recognition as a beneficiary of temporary protection.

 

1.1 Who may use the electronic data recording platform?

The electronic data recording platform was developed specifically for persons fleeing to Hungary en masse due to the Russian and Ukrainian conflict. Thus, only in relation to the submission of their application for recognition as a beneficiary of temporary protection is the platform to be used.

 

Only persons who fled Ukraine after 24 February 2022 are entitled to use the electronic data recording platform who are

Ukrainian nationals; or

- Persons who were previously living in Ukraine as stateless persons (i.e., who do not have a citizenship) or refugees (i.e., who are citizens of another country but were recognised as a refugee by Ukraine); or

- Third-country national family members of Ukrainian nationals, stateless persons or  refugees (i.e., a spouse, a registered partner, children under the age of 18, a dependent relative who was supported by the Ukrainian national, e.g., an elderly parent, a sick sibling).

 

1.2 Who may not use the electronic data recording platform?

Ukrainian nationals who entered the territory of Hungary before 24 February 2022 can arrange the legality of their stay within the territory of Hungary not under the legal title of ‘beneficiary of temporary protection’ but by other means.

1.3 What steps are required to be taken if someone decides not to submit an application for recognition as a beneficiary of temporary protection following data recording electronically?

If you upload your data on the electronic platform but later decide not to submit an application for recognition as a beneficiary of temporary protection, there are no further steps to be taken by you.

 

The Asylum Authority will store the uploaded data until 31 December 2023 and then delete it. It is also possible to get your data deleted earlier as described in the General Data Protection Notice.

 

2.      Application submission

For the purpose of applying for recognition as a beneficiary of temporary protection, after uploading their data, applicants are required to appear in person before the Asylum Authority or a Government Office. Family members are required to  submit their applications at the same time. If the applications of various family members are not submitted together, family members already recognised as beneficiaries of temporary protection are required to be indicated.

 

2.1 What is the use of recording data electronically if I need to appear in person nonetheless?

 

Electronic data recording provides the Asylum Authority with the opportunity to inform applicants of relevant circumstances, e.g., about missing data, via the email address they provided during registration on the electronic data recording platform. Recording data in advance effectively reduces the time of application submission administration; an application for recognition as a beneficiary of temporary protection may be submitted before Government Offices as well.

 

2.2 Where shall I appear to submit my application?

 

An applicant, who has already provided his/her data to the Asylum Authority via the electronic data recording platform, can submit his/her application before person in any of the Government Offices as well.

 

An application for recognition as a beneficiary of temporary protection can be submitted before the Client Service Office of competent regional directorate of NDGAP as per the applicant’s place of accommodation in Hungary during office hours, in person. In Budapest, an application for recognition as a beneficiary of temporary protection can be submitted before the Client Service Office of the Asylum Authority operating at H-1117 Budapest, 60 Budafoki út, Building “A”.

 

Office hours of the Client Service Office of the Asylum Authority:

From Monday to Thursday:        8:00-14:00

Friday:                                             8:00-11:30

 

In case a large group (exceeding  than 10 persons) of applicants is expected to appear in person before NDGAP, the group is advised to contact the relevant regional directorate or the Asylum Directorate in advance to avoid long waiting periods. 

 

2.3 What (documents) re required to be taken with me for the submission of my application in person?

When appearing in person, clients are required to bring along the completed form, and their passport/other available personal documents (in the absence of a passport, personal identification card, birth certificate, form of data entitling its holder for temporary residence, etc.).

 

2.4 Procedure for application submission

The authority will check and record the personal data (e.g., name, date of birth, nationality, marital status, etc.) of the applicant, indicated on the form completed and signed by the applicant appearing in person before the authority; the place and date of the applicant’s entry into the territory of Hungary at the relevant border crossing point; the address of the applicant’s accommodation in Hungary; the authority will take a facial photograph of the applicant and, in case of a person over 14 years of age, his/her fingerprints.

The Asylum Authority verifies the identity of the applicant for recognition as a beneficiary of temporary protection, mainly by means of the various documents, e.g., his/her passport, personal identification card, driving licence, birth certificate, etc., as well as other types of documents presented by him/her to the authority.

An application for recognition as a beneficiary of temporary protection shall be received following verification and recording of the applicant’s personal data, as well as taking his/her biometric data.
